Painting is where NSW law runs against instinct. Schedule 1 of the Home Building Act 1989 excludes internal painting work from residential building work, and the state's own painting page says it plainly: "stand-alone contracts for internal paintwork no longer need a licence". Exterior painting, and interior painting written into a larger renovation contract, fall under the $5,000 labour-and-materials threshold set by the Home Building Regulation 2014. Decorating — wallpaper and murals — carries no equivalent carve-out. Every painter below is checked against NSW's public register at verify.licence.nsw.gov.au, with the verification date recorded.

Where a painted surface sits matters more than what the job costs. Common questions

Does an exterior repaint need a licensed painter when an interior one doesn't?

Yes, and the asymmetry is in the Act itself. Schedule 1 of the Home Building Act 1989 excludes internal painting work from residential building work, which is why NSW's painting page states that stand-alone contracts for internal paintwork no longer need a licence. Exterior painting was never inside that exclusion, so it is residential building work and the Home Building Regulation 2014 requires a contractor licence once the reasonable market cost of labour and materials exceeds $5,000. The exclusion for interior work also lifts where the painting is part only of the work under a contract to do other residential building work.

My painter is repainting as part of a bathroom renovation — does that change the licence position?

It does. The carve-out for internal painting does not apply where the painting is part only of the work to be done under a contract to do residential building work, so interior painting bundled into a renovation contract sits back inside residential building work and the $5,000 threshold applies to that contract. A second rule then arrives from the same Regulation: a contractor holding a building-work category licence must not do the specialist work involved — the plumbing or electrical side of a bathroom — and must subcontract it to a holder of a contractor licence in the relevant specialist category, unless they hold that category too.

Is wallpaper the same licence category as paint?

No. The Home Building Regulation 2014 lists painting and decorating as separate trade categories, and its Schedule 4 describes decorating as the installation of painted or applied decorations such as murals, frescos or wallpaper. Decorating has no equivalent to the internal-painting exclusion, so the $5,000 labour-and-materials threshold reaches it in the ordinary way — a papering contract and a painting contract at the same price can land on opposite sides of the licensing line. On the register the categories appear as Painter and Decorator; a contractor may hold either or both, and each listing shows what is on record.

I want to repaint the inside of my apartment — does the owners corporation get a say?

For the interior, generally not. Painting appears in the cosmetic work list at s 109 of the Strata Schemes Management Act 2015, which an owner may carry out on common property in connection with their lot without approval — the same list carries laying carpet, hanging hooks and internal blinds. What changes the answer is scope: s 109(5) takes structural change, external appearance, waterproofing, plumbing and exhaust systems out of cosmetic work entirely. So an interior repaint and a repaint that reaches an external face are different requests, not different sizes of the same one.

Does the register check on this page also tell me whether a painter is insured?

No — they are separate lookups. NSW's public register returns the licence number and status, the category of work the holder is licensed to undertake, the commencement and renewal dates, the current expiry date, and any suspension or cancellation date. Home Building Compensation cover is checked separately through the HBC Check at verify.licence.nsw.gov.au/home/HBCF, and the Home Building Act 1989 requires that cover only where the contract price is more than $20,000 including GST, which most single-room repaints sit well below. The register also states that it holds no consumer complaint or investigation information.
