Not automatically. Gasfitting work is not even defined in the Home Building Act — the Act adopts the meaning given in the Gas Supply Act 1996. Many tradespeople hold more than one of these categories. A pipe burst at midnight and the plumber wrote nothing down before starting — is that allowed?

There is a narrow statutory exemption for exactly this. Section 6(2) of the Home Building Act 1989 switches off the contract, deposit and cooling-off requirements where the work is needed so promptly that complying with them is not possible, and where not doing the work promptly would likely cause a hazard to health or safety, or damage to property. It is a genuine emergency carve-out, not a general excuse — once the immediate hazard is dealt with, any further staged work goes back under the ordinary contract rules, and the licensing requirement itself never lifts.
